Terms of Service

Welcome to Wizip. These Terms of Service ("Terms") govern your access to and use of the Wizip platform, including our website at wizip.io, mobile applications, AI-powered features, and all related services (collectively, the "Service"), operated by Fennelsmart, Inc. ("Fennelsmart," "we," "us," or "our").

By creating an account, accessing, or using Wizip, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.


1. Eligibility

You must be at least 13 years old to use Wizip. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use Wizip with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will promptly delete their account and associated data.


2. Description of Service

Wizip is a platform for discovering, sharing, and optimizing smart home automation and device compatibility. The Service includes:

  • Device Database: A curated catalog of smart home devices with specifications, compatibility information, pricing, and purchase links.
  • Automation Recipes: User-created and shared smart home automation workflows.
  • Community Features: Comments, likes, and interaction on published automations.
  • My Devices: A personal inventory for tracking your owned smart home devices.
  • Device Requests: A mechanism to request new devices be added to the database.
  • Wiz AI Assistant: An AI-powered smart home consultant that provides personalized device recommendations, compatibility analysis, and automation guidance (see Section 8 for specific terms).

Wizip earns revenue through affiliate marketing partnerships (see Section 7) and may introduce additional features or revenue models in the future.


3. User Accounts

3.1 Account Creation. You may create an account using an email address and password or through Google OAuth. You must provide accurate, current, and complete information during registration and keep your account information updated.

3.2 Account Security. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at support@fennelsmart.com if you suspect unauthorized access to your account.

3.3 One Account Per Person. Each individual may maintain only one account. You must not share your account credentials with others or allow others to access the Service through your account.

3.4 Account Deletion. You may delete your account at any time by contacting us at support@fennelsmart.com or through controls available within the Service. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Published content (automations, comments) that has already been distributed or cached may persist as described in Section 5.


4. Acceptable Use

You agree to use Wizip only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any unlawful, fraudulent, or malicious purpose.
  • Submit false, misleading, or deceptive content.
  • Harass, abuse, threaten, or harm other users.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service's infrastructure.
  • Use automated tools, bots, scrapers, or crawlers to access or extract data from the Service without our prior written consent.
  • Interfere with, disrupt, or create an undue burden on the Service or its underlying infrastructure.
  • Circumvent or attempt to circumvent rate limits, security measures, or access controls.
  • Upload or transmit viruses, malware, or other harmful code.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to develop a competing product or service.

For additional acceptable use terms specific to Wiz AI, see Section 8.5.

Violation of this Section may result in suspension or termination of your account at our sole discretion.


5. User-Generated Content

5.1 Your Content. "User Content" refers to any content you create, upload, or submit to Wizip, including automation recipes, comments, images, videos, device requests, and profile information.

5.2 Ownership. You retain ownership of your User Content. Fennelsmart does not claim ownership of any content you submit to the Service.

5.3 License to Fennelsmart. By submitting User Content to Wizip, you grant Fennelsmart a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, and transferable license to use, display, reproduce, modify, adapt, translate, distribute, and create derivative works of your User Content solely for the purposes of operating, promoting, and improving the Wizip platform and related services. This license includes the right to display your automations to other users, translate content between supported languages, and include your content in aggregated or anonymized datasets. This license does not grant Fennelsmart the right to sell your User Content as a standalone product.

5.4 License to Other Users. By publishing an automation recipe on Wizip, you grant other Wizip users a non-exclusive, royalty-free license to view, save, and implement your automation for personal, non-commercial use.

5.5 Content Representations. You represent and warrant that: (a) you own or have the necessary rights to submit your User Content; (b) your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party; (c) your User Content does not violate any applicable law or regulation; and (d) your User Content is not false, misleading, defamatory, obscene, or otherwise objectionable.

5.6 Content Moderation. Fennelsmart reserves the right, but has no obligation, to review, edit, or remove any User Content that violates these Terms or that we deem inappropriate at our sole discretion. Automation owners may moderate comments on their published automations, including the ability to delete comments. Content moderation decisions may be appealed by contacting support@fennelsmart.com.

5.7 Effect of Account Deletion on Content. Upon account deletion, your published automations and comments may remain on the platform under the license granted in Section 5.3 and 5.4, though your identifying information will be anonymized. Cached or distributed content may persist for up to 90 days after deletion.


6. Intellectual Property

6.1 Fennelsmart's IP. The Service, including its design, software, code, database compilation, text, graphics, logos, and trademarks (including "Wizip") are the property of Fennelsmart or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks without our prior written consent.

6.2 Device Information. Device specifications, images, and pricing in the Wizip database are sourced from manufacturers, retailers, and public sources. Wizip's compilation, organization, and presentation of this data is protected by copyright. Individual device images remain the property of their respective owners.

6.3 AI-Generated Content. Responses generated by Wiz AI are produced by artificial intelligence and may not be eligible for copyright protection under applicable law. You may use Wiz responses for your personal purposes but may not represent them as original human-authored works.

6.4 Feedback. If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant Fennelsmart a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use such Feedback for any purpose without compensation or attribution.


7. Affiliate Disclosure

7.1 Affiliate Relationships. Wizip participates in affiliate marketing programs, including the Amazon Services LLC Associates Program and the Coupang Partners Program. When you click on product links on Wizip and make a qualifying purchase, Fennelsmart may earn a commission at no additional cost to you.

7.2 Editorial Independence. Affiliate relationships do not influence the factual accuracy of device specifications, compatibility information, or user ratings in our database. Device information is maintained independently of affiliate considerations.

7.3 AI Recommendations. When Wiz AI recommends products, some of those products may generate affiliate commission for Fennelsmart. When applicable, this will be disclosed alongside the recommendation. The AI is designed to provide the most relevant recommendations based on your needs, regardless of affiliate status.

7.4 Required Disclosure. As an Amazon Associate, Fennelsmart, Inc. earns from qualifying purchases. This site also participates in other affiliate programs and may earn commissions from qualifying purchases through linked retailers.


8. Wiz AI Smart Home Assistant

8.1 Nature of Service. Wiz is an AI-powered smart home assistant that provides personalized device recommendations, compatibility analysis, and automation guidance. All Wiz responses are generated by artificial intelligence, not by humans. Wiz uses third-party AI models accessed through paid API services to generate responses.

8.2 Consent Required. Use of Wiz requires your explicit opt-in consent, which will be requested the first time you access the Wiz feature. By opting in, you agree to the collection and processing of data as described in this Section and in our Privacy Policy. You may withdraw your consent at any time by contacting us at support@fennelsmart.com or through controls available within the Service, which will disable Wiz features and allow you to delete your Wiz-related data.

8.3 How Wiz Uses Your Data. To provide personalized recommendations, Wiz accesses and uses the following data in real-time:

  • Your conversation messages and history with Wiz
  • Your smart home profile information (housing type, platforms, preferences) collected through conversation
  • Your My Devices inventory
  • The Wizip device and automation databases

This data is provided as context to third-party AI models at the time of each conversation to generate relevant responses. This is real-time personalization β€” the AI models' underlying capabilities are not modified, trained, or fine-tuned using your data. Your data is used to inform individual responses, not to change how the AI works.

8.4 Third-Party AI Providers. Wiz uses paid API services from third-party AI providers. Under the terms of these paid API agreements, your conversation data is not used by these providers to train, improve, or develop their AI models. We may change AI providers at any time; if such a change materially affects how your data is processed, we will notify you and, where required, request renewed consent.

8.5 Prohibited Uses of Wiz. In addition to the general acceptable use terms in Section 4, you agree NOT to:

  • Use Wiz for purposes unrelated to smart home consultation, device information, or home automation.
  • Attempt to extract, reveal, or reverse-engineer Wiz's system prompts, internal instructions, or underlying architecture.
  • Attempt to manipulate Wiz's behavior through prompt injection, jailbreaking, or similar techniques.
  • Use Wiz to generate content that is harmful, illegal, abusive, discriminatory, or that violates the rights of others.
  • Use automated or programmatic methods to interact with Wiz without authorization.
  • Rely on Wiz for safety-critical decisions involving electrical systems, gas, water, or structural modifications without consulting a qualified professional.

8.6 Disclaimers.

  • Not Professional Advice. Wiz provides informational recommendations only. Wiz is NOT a licensed electrician, professional smart home installer, certified home inspector, or any other type of professional advisor. Wiz's recommendations should not be treated as a substitute for professional consultation.
  • Accuracy Limitations. Device compatibility assessments are based on available database information and AI analysis. They may not reflect real-world conditions, latest firmware updates, regional availability, or manufacturer-specific quirks. Compatibility results include confidence levels and should be evaluated accordingly.
  • No Purchase Guarantees. Fennelsmart is not liable for purchase decisions made based on Wiz recommendations. You are responsible for independently verifying device compatibility, pricing, and suitability before making any purchase.
  • Service Availability. Wiz relies on third-party AI services and may experience interruptions, degraded performance, or temporary unavailability. We do not guarantee uninterrupted access to Wiz.

8.7 Usage Limits. Wiz is subject to daily usage limits per user, measured in tokens (a unit of AI processing). Current usage limits are disclosed within the Wiz interface. Fennelsmart reserves the right to modify usage limits at any time. Excessive or abusive usage may result in temporary or permanent restriction of Wiz access. Future service plans may offer different usage limits.


9. Device Information and Compatibility

9.1 Information Accuracy. Device information in the Wizip database, including specifications, compatibility data, pricing, and availability, is provided "AS-IS" and "AS-AVAILABLE." While we strive to maintain accurate and up-to-date information, we do not guarantee its completeness, accuracy, or currency.

9.2 Pricing. Device prices displayed on Wizip are fetched from third-party sources (such as Amazon and Coupang) and may not reflect real-time pricing, promotions, or availability. Prices are provided for reference only.

9.3 Compatibility Disclaimer. Wizip does not guarantee that devices listed as compatible will work together in all configurations. Certain devices may not work or may cease to work with other devices or platforms despite supporting the same protocols or standards. Factors including firmware versions, regional restrictions, hub requirements, and manufacturer-specific implementations may affect real-world compatibility. Users are responsible for verifying device compatibility with their specific setup before making purchases.


10. Copyright Infringement (DMCA Policy)

10.1 Respect for IP Rights. Fennelsmart respects the intellectual property rights of others and expects users to do the same.

10.2 DMCA Takedown Notices. If you believe that content on Wizip infringes your copyright, please submit a written notice to our designated DMCA agent containing:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material on Wizip that you claim is infringing, including the URL or other specific location.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  • Your physical or electronic signature.

10.3 Counter-Notifications. If you believe your content was removed in error, you may submit a counter-notification. We will process counter-notifications in accordance with the DMCA.

10.4 Repeat Infringers. Fennelsmart will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.


11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. FENNELSMART SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, FENNELSMART DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • DEVICE COMPATIBILITY INFORMATION WILL BE COMPLETE, ACCURATE, OR CURRENT;
  • AUTOMATION RECIPES WILL FUNCTION AS DESCRIBED IN ALL ENVIRONMENTS;
  • AI-GENERATED RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC SITUATION;
  • ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR
  • THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FENNELSMART, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, DATA, OR GOODWILL; DEVICE DAMAGE OR MALFUNCTION; PROPERTY DAMAGE; PERSONAL INJURY; COST OF PROCUREMENT OF SUBSTITUTE SERVICES; OR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF FENNELSMART HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FENNELSMART'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO FENNELSMART IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).

THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


13. Indemnification

You agree to indemnify, defend, and hold harmless Fennelsmart and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of any third party.


14. Dispute Resolution

14.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14.2 Informal Resolution. Before filing any formal dispute, you agree to first contact us at support@fennelsmart.com and attempt to resolve the dispute informally for at least 30 days.

14.3 Binding Arbitration. If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

14.4 Small Claims Exception. Notwithstanding Section 14.3, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

14.5 Class Action Waiver. YOU AND FENNELSMART AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. This waiver does not apply to claims arising from sexual assault or sexual harassment, in accordance with the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 (9 U.S.C. Β§ 402).

14.6 Exception for South Korean Users. If you are a resident of the Republic of Korea, you may elect to resolve disputes through the Korean Commercial Arbitration Board (KCAB) or the courts of competent jurisdiction in Seoul, Republic of Korea, in accordance with Korean law. Nothing in this Section shall prevent you from exercising any non-waivable rights available to you under Korean consumer protection law.


15. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email (using the email address associated with your account) or through a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and delete your account.


16. Termination

16.1 By You. You may terminate these Terms at any time by deleting your account by contacting us at support@fennelsmart.com or through controls available within the Service.

16.2 By Fennelsmart. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is harmful to the Service or Fennelsmart. In cases of severe violation, termination may be immediate. For less severe violations, we will endeavor to provide notice and an opportunity to cure the violation.

16.3 Effect of Termination. Upon termination: (a) your right to access and use the Service ceases immediately; (b) your personal data will be deleted in accordance with our Privacy Policy; (c) the licenses you granted under Section 5.3 and 5.4 shall survive with respect to content already published; (d) Sections 5.3, 5.4, 6, 11, 12, 13, 14, and this Section 16.3 shall survive termination.


17. General Provisions

17.1 Entire Agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fennelsmart regarding the Service and supersede all prior agreements.

17.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

17.3 Waiver. Fennelsmart's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment. You may not assign your rights or obligations under these Terms without Fennelsmart's prior written consent. Fennelsmart may assign its rights and obligations without restriction.

17.5 Force Majeure. Fennelsmart shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, war, terrorism, pandemic, labor disputes, government actions, or failures of third-party services.

17.6 Notices. Notices to you may be made via email to the address associated with your account or by posting within the Service. Notices to Fennelsmart should be sent to support@fennelsmart.com.

17.7 Language. These Terms are written in English. If translated into another language, the English version shall prevail in the event of any conflict or inconsistency.
